Justice Uday Umesh Lalit on Saturday took oath as the 49th Chief Justice of India (CJI). He was administered the oath of office by President Droupadi Murmu at the Rashtrapati Bhavan. Justice Lalit became the second CJI to be directly elevated to the Supreme Court from the Bar. The first was Justice Sarv Mittra Sikri, who served as CJI from January, 1971 to April, 1973. Justice Lalit was born on November 9, 1957 in Solapur town of Maharashtra. His father, Justice U.R. Lalit, served as Judge of the Bombay High Court and is a Senior Advocate. He enrolled as an advocate in June, 1983 and practiced at the Bombay High Court till December, 1985. He moved to the national capital in January, 1986 and was later designated a Senior Advocate of the Supreme Court in April, 2004. The Supreme Court has today ordered that in view of the complexity of issue, a 3-judge bench shall hear the plea against freebies promised by political parties before elections. A Bench which was led by Chief Justice of India (CJI) NV Ramana along with Justice Hima Kohli and Justice CT Ravikumar, said that the top court’s 2013 judgment in Subramaniam Balaji v. Govt. of Tamil Nadu needs a reconsideration. The Court said that “ We direct listing of the case before a three judge bench as formulated by the CJI. This is looking at the complexity of the case and a need to reconsider the Subramaniam Balaji judgment.” There are certain matters which have been raised by various parties need consideration by the Court like – What is scope of judicial intervention? – Can court pass any enforceable order? – What should be the composition of the committee? – If the Subramaniam Balaji v. The Supreme Court on Friday, will hear the pleas seeking directions to the National Testing Agency (NTA) for conducting additional sessions of IIT-JEE Mains Examination 2022 for both the first and the second sessions which were disrupted owing to some technical glitches. A bench by Justices DY Chandrachud, AS Bopanna and JB Pardiwala will hear all four petitions raising this issue. The petitions have been put by the candidates who had appeared in these sessions and were faced with technical glitches. The students claimed that the glitches affected their overall performance.The students faced five major problems: 1. The questions of the examination did not appear on the screen at the start, and were intermittently disappearing and re-appearing. 2. The options to move to the next question, etc. stopped working intermittently. 3. Blank screens or frozen screens and software crashes. 4. The Supreme Court on Friday dismissed a petition challenging the dropping of hate speech and other charges against Uttar Pradesh Chief Minister Yogi Adityanath in relation to the 2007 Gorakhpur riots. A Bench led by outgoing Chief Justice of India NV Ramana stated, “Not necessary to go into issue of denial of sanction in this case. The legal questions of sanction will be kept open to be dealt with in an appropriate case.” The Court was dealing with a petition challenging the decision of the Uttar Pradesh government to effectively drop the 2007 Gorakhpur riots cases involving Chief Minister Yogi Adityanath by not granting sanction for his prosecution. During the course of hearings before the apex court, Senior Advocate Mukul Rohatgi, appearing for the CM, had earlier submitted that nothing was remaining in the matter after forensic and closure reports had been accepted. For the first time in the history of the Supreme Court, the proceedings of the Apex Court were streamed live on Friday. As the Court braced up to bid farewell to Chief Justice N.V. Ramana, the ceremonial bench of outgoing CJI Ramana, CJI designate Justice U.U. Lalit and Justice Hima Kohli took up a few important cases. Dushyant Dave, Senior Advocate and former President of the Supreme Court Bar Association (SCBA), broke down as he bid farewell to the CJI. Calling him a ‘Citizen’s judge’, Mr. Dave said Justice Ramana has always performed his duty with a spine.  He further said that Justice Ramana was leaving the court in the great hands of Justice Lalit (CJI designate) and Justice Kohli. Mr. Dave concluded by thanking the 48th CJI for the contribution he made during around eight years in the Supreme Court and said he will be missed dearly.
