Allahabad HC directs special court to decide Rs 9.25 lakh cheque bounce case within two months

The Allahabad High Court has asked the Special Court, Negotiable Instruments Act, Prayagraj, to decide the cheque bounce case of Rs 9.25 lakh within two months.

A single-judge bench of Justice Rajiv Gupta passed this order while hearing an application under Section 482 CrPC filed by one Dharmendra Singh.

The bench noted, “The court below is directed to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of two months from the date of filing of certified copy of the order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the case. With the aforesaid direction, the application under Section 482 CrPC is finally disposed of.”

The counsel appearing on behalf of the applicant has submitted that the execution case in the complaint case is pending since March 2, 2020 and the proceeding has been lingering on, on one pretext or the other. The application under Section 482 CrPC has been filed by the applicant with a prayer to direct the Incharge Special Judge (N.I. Act), Allahabad to decide the miscellaneous execution case in complaint case under Section 138 of Negotiable Instruments Act, Police Station New Cantt., District Allahabad within stipulated time-period.
