Hapur attack: Supreme Court issues notice on plea by AIMIM chief Asadduddin Owaisi
The Supreme Court on Friday issued notice on a petition filed by All India Majlis-e-Ittehadul Muslimeen President Asadduddin Owaisi, challenging the Allahabad High Court’s decision to grant bail to two persons, who attacked his convoy in Uttar Pradesh in February this year.
The two-Judge Bench of Justice M.R. Shah and Justice Krishna Murari issued notice on the aspect as to why the High Court should not be asked to consider the bail plea afresh.
The Apex Court fixed November 11 as the next date of hearing.
The convoy of the Lok Sabha MP from Hyderabad had come under attack in Hapur in Uttar Pradesh, while he was returning after attending events related to campaigning for the Rajya Sabha elections.
One of the accused was arrested within 24 hours of the incident, while the other one surrendered later. They were identified as Shubham, native of Nakur in Saharanpur and Sachin, resident of Badalpur in Gautam Buddh Nagar.
According to police, the accused said they were triggered by the provocative statements made by Owaisi and his party members and decided to attack him.
An FIR for attempt to murder was lodged at Pilakhua Police Station under Section 307 (attempt to murder) of the Indian Penal Code and Section 7 of the Criminal Amendment Act.
The accused were remanded to judicial custody. Police said that two pistols were seized from accused, while a car was also impounded in connection with the case.
They were later granted bail by the Allahabad High Court, which was challenged in the Apex Court by the AIMIM chief.
