Disproportionate assets case:Madras High Court sentences three years of imprisonment to TN Higher Education Minister and his wife Visalatchi

The Madras High Court has sentenced three years of simple imprisonment to the Tamil Nadu Higher Education Minister K Ponmudi and his wife Visalatchi to three in a disproportionate assets case.

Justice G Jayachandran pronounced the sentence today after having convicted the duo on December 19.

Ponmudi and his wife were also ordered to pay a fine of ₹50 lakh in addition to their jail sentence.

The trial court’s decision to acquit the couple in the corruption case was recently overturned by Justice Jayachandran earlier this week, after which they were directed to appear before the Court for the imposition of punishment.

Ponmudi and his wife were present in the courtroom today when the sentence was pronounced. They requested the Court to show some leniency, considering their age and since it was an old case.

In April 2016, T Sundaramoorthy, a special Judge for cases under the Prevention of Corruption Act, had acquitted Ponmudi and Visalatchi saying that the prosecution, who had claimed that the couple possessed wealth and assets worth ₹1.75 crores in excess of their known sources of income, had failed to establish the guilt of the accused.

DVAC, the prosecution in the case, had filed an appeal challenging this order and the DVAC’s appeal was upheld by the High Court.

Ponmudi and his wife are also parties to a suo motu revision case initiated by the High Court earlier this year questioning the couple’s acquittal in another case of disproportionate assets in June this year by now-retired principal district judge N Vasanthaleela.

Touching private parts of minor, kissing on lips does not amount to offence under Section 177 of IPC: Bombay High Court

The Bombay High Court has observed that touching private parts of a minor and kissing on lips do not amount to unnatural offence under Section 377 of the Indian Penal Code. A Single-Judge Bench of Justice Anuja Prabhudessai made the remarks, while granting bail to an accused, after noting that the POCSO offences with which the accused was charged, were punishable with maximum imprisonment up to five years and the accused had been in custody for almost a year. It noted that the statement of the victim as well as the First Information Report prima facie indicated that the Applicant had touched the private parts of the victim and had kissed his lips. Centre notifies rules for consumer protection, direct selling entities not to promote pyramid schemes

The Central Government on Tuesday has notified the rules for Consumer Protection. The Ministry Of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs by exercising the powers conferred by clause (zg) of sub-section (2) of section 101 read with section 94 of the Consumer Protection Act, 2019, has made the Consumer Protection rules. The rules notified by the Centre to be called as Consumer Protection (Direct Selling) Rules, 2021. The Central government prohibited direct selling companies from promoting Pyramid Schemes. The notification also prohibits any person from enrolling into such a scheme in order to undertake direct selling business.
